Third-Party Services & Partnerships

From time to time we may recommend or introduce independent landscape service providers (“Partners”). If you choose to hire a Partner, your contract is solely with that Partner, not with us. We do not supervise, direct, or control Partner personnel and we do not guarantee their pricing, scheduling, or workmanship.

Independent Contractor

Partners operate as independent contractors—they are not our employees, agents, or representatives, and no joint venture or partnership is created between us for your project.

Scope of Responsibility

  • We are responsible for: selling and delivering nursery plants/products as listed on your order, and honoring our published plant health/DOA policies.

  • Partner is responsible for: all labor and services (design, installation, hardscape, irrigation, clean-up), permits as applicable, site protection, and workmanship warranties.

Payments, Refunds & Credits

  • You may be invoiced separately by us (for plants/products) and by the Partner (for services).

  • Refunds, credits, or charge adjustments for Partner services must come from the Partner. We do not issue refunds/credits for third-party services we do not provide.

Warranties

  • Plant warranty (ours): as stated in our Plant Warranty/Arrival Policy (exclusions include neglect, weather extremes, site conditions, etc.).

  • Installation/workmanship warranty (Partner’s): any guarantees related to installation, grading, drainage, hardscape, or labor are offered by the Partner and must be claimed with the Partner.

Claims & Support Path

  • Product/plant issues: contact us at [support email/phone] within the stated timeframes.

  • Service/installation issues: contact the Partner directly at [partner contact]. We may assist with introductions, but we are not responsible for investigating or resolving service disputes.

Limitation of Liability (re: Partner Work)

To the maximum extent permitted by law, we are not liable for any losses, damages, costs, or claims arising from or related to Partner services, including delays, performance, workmanship, or warranties. Your sole recourse for Partner services is with the Partner.

Insurance & Licensing

Partners are solely responsible for maintaining all required licenses and insurance (general liability, workers’ compensation, auto, etc.). Proof of coverage is available from the Partner upon request.

Scheduling, Changes & Extras

Scheduling, change orders, and any scope additions are managed and billed by the Partner. Prices and timelines may change based on site conditions and your approvals.

Photos & Marketing

With your permission, we and/or the Partner may photograph the project for portfolio/marketing. Location details will not be disclosed.

Disclosure of Material Connection (if applicable)

We may receive a referral fee or commission if you purchase services from a Partner we introduce. This disclosure is made in accordance with applicable advertising and endorsement rules.
